Arte Moreno, owner of the Los Angeles Angels, and his wife are heading to trial over their 2019 withdrawal from purchasing a $34 m penthouse at 520 Park Avenue, developed by Arthur Zeckendorf. Citing noise concerns from a nearby mechanical room, the Morenos backed out after placing an $8.5 m deposit. Zeckendorf sold the unit in 2022 and sued the couple for $10 m, while the Morenos countersued for their deposit. The dispute, centered on alleged noise affecting the unit’s “quiet enjoyment,” will proceed after a federal judge denied summary judgment. Both parties have hired legal counsel for the trial.
