The owners of Masjid Al-Baqi mosque in Bethpage, Long Island, have filed a federal lawsuit against the Town of Oyster Bay and its planning advisory board. The lawsuit claims that the town violated state and federal laws by obstructing the mosque’s ability to expand. The mosque has owned the property at 320 Central Avenue since the 1990s and has sought approval for a three-story building to replace two existing one-story structures. Despite submitting a plan in 2018, the town allegedly required numerous revisions and passed a law in 2022 that increased parking requirements for religious institutions. The mosque’s application was ultimately denied in November. The town attorney has called the claims “baseless” and “unjustified.”
